Violation of fundamental European rights: The Case of the Migratory Policies of the Government Giorgia Meloni

Avatar: Fabrice Vulpio Fabrice Vulpio

The Meloni government's migration policies raise serious concerns about respect for the principles enshrined in the Charter of Fundamental Rights of the European Union (CDFUE). Article 1 of the Charter states that "human dignity is inviolable", but the criminalisation of migrants and the inhumane conditions in reception centres profoundly undermine this principle. Arbitrary detentions and pushbacks violate the freedom and security guaranteed by Article 6, while the narrative portraying migrants as threats contradicts Articles 20 and 21, which proclaim equality and non-discrimination. In addition, the cut of funds to reception contrasts with Article 34, which guarantees social and housing assistance for a dignified life. Arbitrary restrictions on the right of residence undermine Article 45 on freedom of movement, while the systematic denial of access to asylum procedures violates the right to an effective remedy enshrined in Article 47. These practices betray European values and risk isolating Italy in the EU, where respect for human rights is paramount. There is an urgent need for a change of course that promotes solidarity, respect for rights and cooperation for a fair management of the migration phenomenon.
