In the panorama of European legislation, the European Commission has presented a legal act, also intended as a draft act, to strengthen the position of farmers in the food supply chain; proposal to amend Regulation (EU) No 1308/2013, Regulation (EU) 2021/2115, Regulation (EU) 2021/2116 and launching a public consultation followed by a report with reasons and objectives, such as how the Common Agricultural Policy (CAP) has been geared towards those measures aimed at ensuring a fair standard of living for the agricultural community. I have written an opinion on this proposal for a regulation (the consultation is available on the European Commission’s Have Your Say institutional platform), in view of Article 39 (TFEU) of the Treaty on the Functioning of the European Union, to assess workers in the labour force as operators in the same agricultural sector, in addition to companies. In addition, the Commission's explanatory memorandum replicates the establishment of written contracts between the parties (seller and buyer) for the delivery of agricultural products. For points 4 and 5 of the report it is considered appropriate to insert a clause for those contracts longer than six months, through the consultation I wrote a comment considering penalties and interests not to be induced to the agricultural company name.
